The program has specific eligibility requirements, including continuous residence in the U.S. since June 2007, and arrival in the country before the age of 16. What Does the DACA Ruling Mean for Me? 

The recent rulings regarding DACA have raised questions for recipients in Texas. Here’s what you need to know based on your situation. 

  • Current DACA Recipients 
    If you currently have DACA and your work authorization has not expired, your status is still valid. You remain protected from deportation and can continue to legally work in the U.S. It is important to stay on top of timelines and submit your renewal application well before your current status expires. 

  • Renewal DACA Applicants 
    Individuals who already have DACA and are seeking to renew their protections can still submit renewal requests. U.S. Citizenship and Immigration Services (USCIS) is processing these applications and approving them if all requirements are met. We recommend initiating your renewal around 120 to 150 days before your current DACA expires to avoid any gap in your status. 

  • Initial DACA Applicants 
    As of July 2021, new DACA applications are not being approved. While USCIS may accept your submission, they are prohibited from granting initial requests or issuing related work authorization due to current court rulings. If you have submitted an initial application, your case will remain on hold unless legal circumstances change.

How Do I Renew My DACA Status?

  1. Keep Track of Deadlines 
    It’s important to renew on time to avoid a lapse in your status. The ideal window for submitting your renewal request is 120 to 150 days before your current status expires. 

  2. Gather Your Documents 
    You’ll need to provide proof of identity, evidence of current DACA approval, and relevant documentation to show you continue to meet DACA’s requirements. 

  3. Submit Form I-821D and Form I-765 
    These forms are required to renew your Deferred Action and Employment Authorization. Be sure to review instructions carefully and ensure all information provided is accurate. 

  4. Pay the Filing Fee 
    There is a standard fee for renewing your application. Fee exemptions are available in limited circumstances if you meet certain criteria.

What to Do If Your DACA Renewal Is Delayed 

A delay in your DACA renewal process can feel overwhelming, but it’s important to know there are steps you can take to address the situation. Acting promptly and staying informed can help you minimize potential challenges during this time. Here’s what to do if your DACA renewal is delayed.

1. Check Your Application Status 

The first step is to verify the status of your renewal application. You can do this by using the USCIS Case Status Online tool. You will need the receipt number that USCIS provided when your application was submitted. If you don’t have your receipt number, check any email confirmation or mailed notices you received when filing. 

If your case status shows processing delays, take note of the timeline and any updates provided. USCIS may include instructions or requests for additional information that could impact the progress of your case. 

2. Contact USCIS Customer Service 

If it’s been more than the expected processing time and your case has been pending for at least 105 days, contact USCIS to request a status update. You can reach their customer service line by calling 1-800-375-5283. Be prepared to provide your application details, including your receipt number and personal identification information. 

3. Submit an E-Request for Case Inquiry 

If reaching out by phone hasn’t addressed the issue, you can file an "Outside Normal Processing Time" notice through the USCIS website. This online inquiry tool allows you to formally notify USCIS of delays beyond the published processing times. You’ll need your receipt information, as well as the details of your application. 

E-Requests are a formal mechanism that can encourage further review of your case. Be sure to clearly explain the reasons for your inquiry within the required fields. 

4. Seek Legal Guidance 

If delays persist or your situation becomes more urgent, seeking legal help can provide clarity and reassurance. Immigration attorneys can help communicate with USCIS on your behalf. Legal professionals can also review your application to check for any issues that might be causing delays.
