What Does the DACA Ruling Mean for Me? 

The recent rulings regarding DACA have raised questions for recipients in Texas. Here’s what you need to know based on your situation. 

• Current DACA Recipients 
  If you currently have DACA and your work authorization has not expired, your status is still valid. You remain protected from deportation and can continue to legally work in the U.S. It is important to stay on top of timelines and submit your renewal application well before your current status expires. 

• Renewal DACA Applicants 
  Individuals who already have DACA and are seeking to renew their protections can still submit renewal requests. U.S. Citizenship and Immigration Services (USCIS) is processing these applications and approving them if all requirements are met. We recommend initiating your renewal around 120 to 150 days before your current DACA expires to avoid any gap in your status. 

• Initial DACA Applicants 
  As of July 2021, new DACA applications are not being approved. While USCIS may accept your submission, they are prohibited from granting initial requests or issuing related work authorization due to current court rulings. If you have submitted an initial application, your case will remain on hold unless legal circumstances change.

How Do I Renew My DACA Status?

   It’s important to renew on time to avoid a lapse in your status. The ideal window for submitting your renewal request is 120 to 150 days before your current status expires. 

2. Gather Your Documents 
   You’ll need to provide proof of identity, evidence of current DACA approval, and relevant documentation to show you continue to meet DACA’s requirements. 

3. Submit Form I-821D and Form I-765 
   These forms are required to renew your Deferred Action and Employment Authorization. Be sure to review instructions carefully and ensure all information provided is accurate. 

4. Pay the Filing Fee 
   There is a standard fee for renewing your application. Fee exemptions are available in limited circumstances if you meet certain criteria.
